Passengers & Loads

Ensure seatbelts, child seats, and luggage are secure. Understand baby seat and airbag rules, plus safe trailer and roof-rack loading.

The full guide

Every passenger in your vehicle must wear a seatbelt by law, and children under 135cm tall or under 12 years old must use an appropriate child restraint. Baby seats must be rear-facing and never placed in the front seat if the airbag is active — the force of deployment can seriously injure an infant. Child seats must be the correct size for the child and properly secured with the seatbelt or ISOFIX points. Before carrying any load, check your vehicle's maximum weight capacity in the handbook. Luggage must be secured so it cannot move during braking or cornering. Heavy items should go low and as far forward as possible. Roof boxes and roof racks must be fitted according to the manufacturer's instructions and must not exceed the vehicle's roof load limit. Trailers require additional checks: coupling security, breakaway cable, lights, and tyre condition. Remember that towing affects braking distances and handling, so allow extra space and reduce speed.

Common faults

  • Not ensuring all passengers are belted before moving off.
  • Placing a rear-facing baby seat in the front with an active airbag.
  • Overloading the vehicle beyond its legal weight limit.
  • Securing luggage poorly so it shifts while driving.
  • Forgetting to check trailer lights and coupling.
  • Not adjusting tyre pressures for heavy loads.

What the examiner looks for

  • Confirmation that seatbelts are fastened before moving off.
  • Knowledge of child seat requirements.
  • Awareness of airbag risks for rear-facing seats.
  • Understanding of vehicle weight limits.
  • Proper securing of any luggage or loads.
  • Safe attitude towards passenger welfare.

Quick tips

  1. 1Check every passenger's seatbelt before you move off.
  2. 2Never put a rear-facing baby seat in the front if the airbag is on.
  3. 3Use ISOFIX points where available for easier, safer fitting.
  4. 4Distribute weight evenly in the boot — heavy items low and forward.
  5. 5When towing, increase following distances and reduce cornering speed.

Common questions about passengers & loads

When can a child stop using a car seat?
Children must use a car seat until they are either 12 years old or 135cm tall, whichever comes first. After that, they must use an adult seatbelt. It is the driver's responsibility to ensure all passengers under 14 are properly restrained.
Is it illegal for passengers not to wear seatbelts?
Yes. As the driver, you are responsible for ensuring all passengers under 14 wear seatbelts. Passengers aged 14 and over are responsible for themselves and can be fined individually. You can be fined up to £500 for each unbelted child.
Can I disable the passenger airbag for a baby seat?
Some vehicles allow you to disable the passenger airbag for a rear-facing baby seat. Check your vehicle handbook. If you cannot disable it, place the baby seat in the back. Never place a rear-facing seat in front of an active airbag.
What is the penalty for overloading a vehicle?
Overloading can result in a fine of up to £300 and three penalty points. In serious cases, the vehicle may be immobilised until the excess weight is removed. Your insurance may also be invalidated if you are involved in an accident while overloaded.
How should I secure luggage in the boot?
Place heavy items low and as far forward as possible. Use cargo nets, straps, or non-slip mats to prevent movement. Never stack items above the rear seat backrest where they could fly forward in a collision and strike occupants.
Do I need a special licence to tow a trailer?
If you passed your test after 19 January 2013, you can tow trailers up to 3,500kg MAM. If you passed before that date, your licence already includes trailer towing entitlement. Always check your vehicle's towing capacity in the handbook before towing.
